mercury news that those proposed laws won't stop crime because criminals don't buy ammunition. they steal it. reporting live, bob redell, "today in the bay" developing news from the korean peninsula. the north adding more threatening rhetoric to its campaign to start an all-out war on the south and the united states. north korea says it will restart one of its nuclear reactors. marla tallez joins us with the latest information. >> this is all part of north korea's daily barrage of threats against the u.s. and south korea. this morning, kim jong-un is promising to dust off the cobwebs of the reactor that was shut down in 2007. estimates va b estimates var y but it is estimated they have enough material to build eight atomic

bombs. this new video showing the north target practice on pictures of u.s. soldiers and new animation shooting down u.s. planes. in response, the united states has stealth fighter jets and bombers overhead and a navy destroyer headed that way. experts say we better be ready. >> i don't think we can take anything for granted. the united states, south korea and our other partners in that region have to be very prepared in the event that something could happen here. the official word from the white house, says so far it is all talk and no action. jay carney says they have not seen any major changes to the north's military in terms of mobilizing or repositioning. another concern this morning is the possibility north korea could sell its nuclear weapons to iran. our white house correspondent, tracie potts, is watching this story from washing. we will hear from her coming up at 5:40. >> thank you very much. now, to a follow-up to a police shooting in the south bay.

san jose mr. is say they are ready to seek charges against two suspects, wounded by a police officer. after they allegedly tried to run him over. this was the scene last wednesday on the road. police opening fire on the 31-year-old woman and a 23-year-old man when they tried to drive off in a stolen car hitting an officer in the process. both suspects were wounded. they are expected to recover. police say both had warrants out for their arrests. they will likely both be in court sometime this week. 5:04. new this morning, a taxi driver under arrest, accused of dui after slamming into the center divide on southbound 101 near the millbrae avenue exit around 1:30 this morning. the cab is wrecked but the driver is not seriously injured. no one else is believed to have been inside that cab at the time of the crash. the man accused of crashing right into a south bay walmart and then attacking customers inside expected to face a judge sometime this morning.

"today in the bay's" arturo santiago is live in san jose with more details on this crash including an eyewitness account. good morning, arturo. >> good morning, john. 33-year-old hamid zi eed has been in court ever since he was arrested on sunday. he is facing a number of charges. zaid is accused of driving into the parking lot on sunday morning and crashing into a couple of cars. after hitting the cars, he allegedly drove into the walmart coming to a stop 30 feet inside the store. then, witnesses say he picked up a metal bar and started attacking people in the store sending four to the hospital. other people grabbed him and held him until police arrived. >> i thought maybe it was road rage, because he came twice past me and hit my car twice. >> a lot of things coming in my mind. something fell and then it was

an earthquake or terrorist attack. >> reporter: he faces four counts of assault with a deadly weapon, hit and run, being under the influence of drugs and resisting arrest. he is currently being held on $200,000 bail. again, 33-year-old hamid zayed will have his first court appearance at 9:00 this morning. i'm arturo santiago, "today in the bay." >> thank you very much. we want to check the forecast with meteorologist, christina loren. >> i like the way you say that. >> she has a nice voice, doesn't she? 52 degrees in san francisco. 45 in novato. we are starting out nice and mild, expecting a beautiful day. temperatures pretty chilly in places like santa cruz. otherwise, 52 degrees in san jose. that is bearable even without a jacket or a light sweater this morning. i want to point out our visabilities are going to continuously drop off as we head through the next few hours, particularly through your north bay valleys.

sunol, censor slowdown into the red category. this is something we are watching as we get to the early morning hours. other than that, we don't have any accidents to report. we give you an a plus at home. >> thank you very much. caltrans admits it saw red flags with bolts that snapped on the new span of the bay bridge before they were installed. the agency said preinstallation tests raised doubts about their ability to stretch during an earthquake. at least 32 of the rods snapped last week when engineers started tightening the bolts. further testing showed hydrogen had contaminated the seal making it brittle. they cannot be removed so they are working on a fix to install new bolts around them. an update on injured louisville player, kevin ware, a devastating scene. we'll let you know what doctors are now saying about him this morning the bay area welcoming some new residents this morning and

welcome back. a live look outside at the marina district of san francisco. the palace of fine arts, to the left. golden gate. should be a nice day. an unexpected apology from apple to the chinese people. scott mcgrew, that apology coming from the ceo this is the second time we have seen tim cook issue an apology. the first was well deserved for apple maps. this new apology is directed towards the people and the government of china. apple has been under fire in the press in china for short shifting chinese consumers,

accused of offering the chinese sub standa substandard warrants on their apple product. that warranty is no less than the warranty you get for your iphone. considering how much of the criticism was coming directly from the chinese government through state-run media, it would appear apple took the safe route and apologized rather than ali alienate the world's biggest market. they apologized for appearing arrogant. their shares slid another 3% on the markets on monday. let's turn to bertha coombs for a look at the broader markets. good morning. good morning. i apologize in advance for the fact that stocks were lower yesterday. this morning, we have the futures a little higher, scott. stocks did fall on monday just slightly. low volume. a number of markets in europe and asia were closed for the monday after easter. the s&p 500 started off the quarter on a loss.

this is the first time it started the quarter on a down side in more than a year. we are going to get data on factory orders. the dow starts at 14572 after slipping five points. the nasdaq starts at 3239 after losing 28. watch health care stocks, particularly the insurers. cms, the sen trs fcenters for m and medicaid. a big reversal when it comes to rate expectations. a lot of the providers, like humana, are going to see their stocks higher. >> we'll watch tesla. shares are going to open at an all-time high, jumping 20% monday after that announcement. the company expected to turn a quarterly profit for the first time. once again, jon and laura, he had an even bigger announcement set for today. this guy, i mean, he shoots rockets to the space station. he develops electric cars. he is the new steve jobs, the p.t. barnum. every time something interesting

pretty mild like john pointed out. if you prefer the 50s, go ahead and wear your coat. at 7:00 a.m., we stop the clock looking for fog. that's where we are expecting it to be at its thickest. we stop the clock by 11:00 a.m. mostly clear over the greater bay area. let's take you into your wednesday as clouds steadily increase ahead of an area of low pressure, not slated to bring us any rain just yet. not until thursday. look at the grief for this thursday morning drive. 7:00 a.m., moderate, even heavy periods of rain make their way along the peninsula. that will continue to push inland as we head through 11:00 a.m. thursday. it is going to be kind of a rough ride. commuting on thursday morning will not be as easy with this rain coming in. we are going to continue showers until 8:00 p.m. thursday. this isn't the most moisture-rich system headed our way. it is a colder system that's got more moisture.

it looks like we are going to get slammed on sunday. 70 for livermore, 66 in fremont and 68 degrees in san jose. here is the seven-day outlook. it works like this. today, tomorrow, we stay dry. thursday, you will need that umbrella. friday, cloudy conditions. not looking toward anything heavy. outdoors on friday. saturday, sunday, things start to change. it looks like you can get out on saturday until about 3:00 p.m. that's whether this soupy conditions develop. by sunday, you want to plan on staying indoors. you see that sideways rain icon. that's an indication of not just heavy downpours but also some really gusty winds headed our way. you no he what, we need that rain right now. so let's take it on, bring it on. bring on the rain, anthony. let's check that drive with you. >> i would have to say, wednesday, 77, looks real good. that would be my pick day of the week to get out and enjoy. you are looking at fremont right now. 880 headed southbound. those are the lights going away from the camera.

northbound, headed towards the camera. you can see things are flowing smoothly. we want to flip over to the traffic map and show you, we are still talking about that accident on 680 on mission boulevard. that's where the accident is. that's what's causing the slowdowns. otherwise, it is a lighter than usual traffic tuesday i would suspect just because folks are still on spring break. i will show you our bay bridge toll plaza. you can see, not a whole lot of traffic. it is starting to build as we get towards the 6:00 hour when it really starts to bog down and also at the golden gate bridge, not a whole lot of fog right now. i would suspect that would change as christina has been mun mentioning. 5:18 right now. new this morning. san jose police on the lookout for a man that attacked two people at a medical clinic friday at a health center near third and east virginia street. police say that man walked into the clinic's emergency room and

then started beating a woman. a bystander tried to intervene. he was struck in the head with a wrench. the man that attacked him ran off. both victims were treated for their injuries. so far, no word on a motive. >> 5:18. arizona's controversial immigration enforcement law will be on the table in a san francisco courtroom today. the law allows police to question people about their immigration status. those against it say it promotes racial profiling. a district judge struck down that law in september saying it was trumped by the federal law. arizona's governor has appealed the decision to the ninth circuit court. we have great news this morning. louisville guard, kevin ware, who suffered that devastating injury sunday, he is expected to be released from the hospital in a few hours. ware, if you recall, broke his leg in two places during a freak fall during the team's elite eight matchup with duke. he literally snapped his leg in two places, rushed to the

hospital where he underwent surgery and doctors are now saying, he is recovering very nicely, already up on crutches. a postage shot on twitter. it is possible he could be on the sidelines for saturday's ball game when his teammates and coaches take on wichita state in the big final four. >> slow down, boy, rest up. >> he wants to be there. got to be there. >> my goodness. 5:19. san jose could be welcoming a new falcon chick this morning. san jose's resident falcon, clara, awaiting the arrival of her youngest chick. three of her four eggs hatched earlier this week. egg number four seems to be taking its time. for the past seven years, clara has nested in a box atop san jose city hall giving us a sneak peek. >> the little chicks come out very hungry, don't they? >> they sure do. we will show you some of the best april fools prank, including one that might get you up and ready this morning. a live look outside.

explosion. officials say all tests across the state should be done by the end of the month. we can now add another bay area community to that growing list of cities supporting same-sex marriage. last night, palo alto city council passing a resolution opposing prop 8, california's ban on same-sex marriage. it also agreed to fly the rainbow flag in front of city hall. several other cities, right here in the bay area showing their support for gay rights just last week as the u.s. supreme court heard two separate cases dealing with same-sex marriage. decisions on those cases are expected in june. yesterday, april fools' day and a lot of praengs were going around. we have some of the best of the best. >> there are some good ones here. check this one out. george hikai of star trek fame hosting that he would play a major j major jedai master. he came up with a film title, star wars, galactic empire.

the u.s. says they will run out of visas for skilled immigrants as early as this week. scott mcgrew is in the newsroom with the details the government started issuing these latest sets of visas and just yesterday says it may run out. there are two kinds, one for highly skilled workers, so in demand. one for foreign graduates of american colleges. together, they total about 85,000 work permits. that is capped by congress. we have reached this cap before. it has been years since we have reached this cap so quickly. looking at this list provided by the government, that's generally true, business experts, engineers, the most common visa holders. doctors and nurses are in the top five as well. american companies say they absolutely need these work permits to fill spaces left

empty. they can't hire enough highly skilled workers so they have to look overseas. critics, though, point out, in general, these foreign workers tend to be paid less and that may be a motivation as well as far as why the companies want these visas so badly. >> very interesting. thank you, scott. new this morning, investigators looking into what caused a fire that burned through an apartment in sunnyvale. crews say when they got to that scene, they found flames throughout one of those apartments and was starting to spread up to the attic. firefighters say it took them about a half hour to finally get things under control. they were able to keep the fire from spreading to other units. the people that lived in that apartment an ariva drive were not home at the time. >> apparently, they had to take their dog to the veterinarian. we don't know if that is a result of the fire or something else that caused them to leave a pot on the stove or something like that. >> just to be safe, crews did

stay on the scene into the morning hours watching for hotspots the man accused of crashing into a south bay walmart, then attacking cut me aattacking customers expected to face a judge this morning. arturo santiago live with details. >> reporter: 33-year-old hamid zaed is scheduled to face a judge just after 9:00 this morning. he is currently being held on $200,000 bail. he is accused of violently disrupting a peaceful easter sunday morning by driving his car into the parking lot of the walmart super center on story road and running into a couple of cars. police say he then drove through the front entrance of the store ending up some 30 feet inside. he allegedly got out of his car and started attacking people inside the walmart with some kind of a metal bar. four people were hurt and sent to the hospital from that attack. others were able to wrestle him

to the ground and hold him there. >> no one in the parking lot was hit by this person. only four people inside the store were acosted. so it's just really kind of an easter miracle. >> reporter: police say he was under the influence of drugs on sunday. he has been in custody in the santa clara county jail since he was arrested. the charges that he faces are four counts of assault with a deadly weapon, hit and run, being under the influence of drugs and resisting arrest. we are live in san jose. i'm arturo santiago, "today in the bay." >> it is 5:33 right now. this morning, marking a sombre day for a small christian college in oakland. seven people were gunned down back on april 2nd, 2012. a memorial concert will be held at st. paul's episcopal church.

it was a former student that carried out the deadly shooting rampage. he is currently undergoing psychiatric treatment at the napa state hospital. bay area lawmakers taking a different approach to gun control here in california. several new bills are set to go before the legislature targeting bullets, not the guns. "today in the bay's" bob redell is live in milpitas with what these lawmakers are trying to get done. good morning. >> reporter: good morning. instead of targeting the guns which are already heavily regulated here in california, lawmakers want to put pressure on the sales of sammunition. they want to require a bill that would require buyers of bullets to submit their names to make sure they were not a criminal or

someone with a mental health issue. ammo dealers would have to become licensed. the california rifle and pistol association has vowed to sue if that bill passes. two other bullet control bills in the wings. los angeles senator kevin deleon's bill would require buyers to submit to a background check and pay an annual permit fee of $50. oakland assemblyman rob bonta's bill would put a 10% tax on am knew nigs to pay for crime prevention. one gun seller tells the mercy news that those proposed bills won't stop crimes, because criminals aren't the ones that buy ammo. they are the ones that steal it. >> bob redell, "today in the bay." 5:36. moving along this morning. good morning to you. 51 degrees in sunnyvale. 52, san jose.

grab your fair-weathered friends for the next couple of days. some choice conditions here in the bay area before more rain arrives. temperatures this morning are cool enough for a jacket. you might be able to get by without one. we do have some thick fog developing. this will continue to be the story as we head throughout the morning. by with 9:10, we should see the fog burning off and partially clear conditions. we should see a mix of sun and clouds. the most sunshine will be coming in early. yesterday, we had to deal with the hour flight delays out of sfo. we still have low ceilings this morning. right now, everything is reported on time out of all our major airports across the nation. it is a business as usual day yesterday. we observe caesar chavez day. 70 degrees inland. 68 bayside and 63 at the coast. clouds decreasing as we head throughout noon. a mix of sun and clouds. that will be the story throughout the day today. we are going to hold off on the rain clouds until thursday morning. i'm going to time out that next storm system. first, want to check your drive on a traffic tuesday.

5:37. yesterday was pretty nice. the towering cumulus. the weatherman in me. i'm here to do traffic this morning. we are talking about some slow-going. bay bridge toll plaza, not too bad. no major accidents to report. fremont, you can see traffic there moving very smoothly. again, we have that slowdown on 880 and this is not really because of any accident by chp. it is just showing up on our maps. you can see that by the yellow/orange censor once you get south of fremont on 880. this is headed southbound. no major accidents to report. on 680 at the mission boulevard ramp, that's where we are still seeing slow-going because of that accident. about an hour ago, it looks like they are still trying to clear that away along with a big-rig and another vehicle.

the white house is making moves to keep the peace on the korean peninsula. the new moves include

fighter jets and stealth bombers and a navy warship now headed to the region. the uss mccain in response to these threats coming from north korea. we understand north korea wants to reopen an old nuclear reactor that's been shut down since 2007. not necessarily an immediate threat but raising concerns of the rhetoric that's coming out of north korea. north korea's leader, kim jong-un gave a speech where he focused more on economic development than military action giving the white house more fodder on what they are saying, this is more talk than action. the u.s. being extremely cautious and today, secretary of state, john kerry, meeting with south korea to try to stabilize things in the korean peninsula at this point.

in franks, polifrom los ang arresting a man in connection with a kidnapping and sexual assault of a ten-year-old girl. she was found 12 hours later wondering six miles away. police at this point have not released any other details but do not believe the suspect knew her family. the search for the remains of more victims of the september 11th attack have resumed. investigators have started sifting through about 60 truckloads of debris unearthed by construction crews working on the new tower at the world trade center. they are expected to spend about ten weeks trying to identify remains. the last time this happened, three years ago, 2,750 people died at the world trade center. in the 2001 terror attacks. only 58% of those remains have been identified. we've an update this morning on the condition of nelson
